THE COMPOST HEAP — PALMSTREET SHOP GUIDELINES The Compost Heap is a New Hampshire nursery offering tropical plants grown in-house. By purchasing, the buyer accepts these guidelines. Nothing here limits non-waivable legal rights or Palmstreet’s mandatory policies. SHIPPING, ADDRESS & TRACKING Please allow 5–10 business days for preparation. Orders normally ship Monday–Wednesday. Standard shipping is charged at the posted flat rate and uses USPS Priority Mail. Second-Day and Overnight upgrades are available only by request before shipment. Multiple purchases may be combined. Eligible shipping overages will be refunded after the label is purchased. Expedited service may shorten transit time but does not guarantee carrier performance. The buyer must provide a complete address, including all unit or mailbox numbers. After tracking is issued, the buyer must review it, report any error, monitor delivery, and retrieve the package. Once accepted by the carrier, address changes may not be possible. We are not responsible for delay, return, loss, theft, misdelivery, or plant damage caused by incorrect information, missed delivery, failure to monitor tracking, failure to retrieve the package, or carrier action. NO INTERNATIONAL SHIPPING OR FREIGHT FORWARDING We do not ship internationally and do not permit orders to freight forwarders, reshippers, consolidators, export services, or addresses intended to move plants outside the United States. We do not provide export preparation, import permits, phytosanitary certificates, or customs documents. Orders connected to forwarding or international reshipment may be canceled. If a buyer forwards or reships a package after delivery, our responsibility ends at the original Palmstreet address. Later handling, storage, customs processing, and transportation are at the buyer’s risk and void all Live Arrival and condition claims. WEATHER & SHIPPING HOLDS We may delay, cancel, or refund an order because of unsafe weather, carrier disruptions, destination restrictions, or legal concerns. Heat packs, insulation, or upgraded shipping may be required. LIVE ARRIVAL GUARANTEE Priority Mail and Second-Day shipping do not include Live Arrival coverage. Coverage applies only when Overnight or next-business-day shipping is requested and paid for before shipment. To qualify, the buyer must retrieve the package; record one continuous, unedited video beginning with the unopened, sealed box and visible label; show the complete unpacking; report the issue with the video within four hours of the first delivery scan or by 11:59 p.m. local time that day, whichever is later; and keep all packaging until the claim is resolved. Dead on Arrival means the plant was nonviable when delivered, such as complete tissue collapse or a destroyed, frozen, rotted, or fully desiccated growth point. Coverage excludes carrier delays, address errors, missed delivery, theft, packages left outside, post-delivery weather exposure, forwarding, customs activity, cosmetic damage, bent or broken leaves, yellowing or loss of older leaves, minor root or substrate disturbance, normal shipping stress, and decline after unpacking. For an approved claim, we may provide a replacement, store credit, partial refund, or refund of the affected plant’s purchase price. PLANT CONDITION, CARE & PESTS Unless stated otherwise, plants are WYSIWYG—What You See Is What You Get. Plants may grow, lose an older leaf, or change cosmetically before shipment. Measurements are approximate. Future growth, color, leaf shape, size, variegation, and growth rate are not guaranteed. Drooping, tears, bent leaves, yellowing, substrate movement, minor root disturbance, or loss of an older leaf may occur during transit and are normal shipping stress, not DOA. Plants are inspected before shipment, but no live plant can be guaranteed permanently pest- or pathogen-free. Quarantine all new plants. After delivery, the buyer is responsible for proper light, temperature, humidity, watering, airflow, acclimation, and pest control. CANCELLATIONS, RETURNS & LIABILITY Because plants are living and perishable, all sales are final except under the Live Arrival terms above, Palmstreet’s mandatory policies, or non-waivable legal rights. Cancellations may be considered before preparation begins. Returns require prior written approval and are not accepted for buyer’s remorse, cosmetic variation, shipping stress, or care-related decline. EXCEPT FOR THE LIVE ARRIVAL TERMS ABOVE AND RIGHTS THAT CANNOT BE WAIVED BY LAW, PLANTS ARE SOLD AS IS, WITH NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPOST HEAP’S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT PAID FOR THE AFFECTED PLANT PLUS ITS ALLOCATED SHIPPING CHARGE. THE COMPOST HEAP IS NOT LIABLE FOR INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES. Thank you for supporting The Compost Heap.
While we encourage sellers to establish clear and detailed shop policies, these policies must align with Palmstreet’s platform policies and Terms and Conditions.
If there is a conflict between a seller’s shop policies and Palmstreet’s platform policies, our platform’s policies take precedence. This ensures a consistent and equitable experience for all users.
