PURCHASE-BASED GIVEAWAY POLICY
At Palmstreet, we want to provide a platform where everyone feels secure in their purchasing decisions. In order to keep this spirit of transparency, we prohibit gambling activities and games that can only be played upon purchase.
This policy is not comprehensive, nor is it intended to be legal advice. It's each seller's responsibility to ensure their livestreams, listings and sales adhere to our Terms & Conditions as well as any applicable laws and regulations.
Giveaways
If your game is enabled by a purchase, the following policy must be adhered to:
- Free Method of Entry: Sellers must also provide a free method of entry for participants. This can be as simple as allowing entry by sending a physical postcard or letter to the seller. (In such cases, you would need to allow time for these entries to count before the prize winner(s) are determined). This ensures that individuals can participate without having to make a purchase or payment. You may also allow an entry for each purchase, but non-buyers must have equal access and chance to win the prize(s).
- Maximum Entries: Limit participants to a maximum of three entries per person to promote fairness and equal opportunities for everyone. This applies to both paid and free entries, and will help to maintain an equal chance of winning for all participants.
- Release of Responsibility: Sellers who wish offer giveaways are required to submit a liability release document to the platform. This document should outline that the seller takes full responsibility for the giveaway and absolves the platform from any liability. An email template of this can be found here and should be emailed to info@palmstreet.app prior to any giveaways.
Additional Requirements
- Your giveaway and your conduct must comply with all relevant federal, state, and local laws, rules, and regulations.
- Your giveaway cannot infringe upon or encourage the infringement of any third-party rights or the participation in any unlawful activity.
- You cannot associate or affiliate Palmstreet with your giveaway or in any way state or do anything that suggests that Palmstreet is involved with or has endorsed your giveaway in any way.
- Your giveaway should have rules for participants that govern how the giveaway will be run.
- You must award all prizes offered as part of your giveaway.
By incorporating these requirements into the policy, sellers can conduct giveaways in livestreams in a responsible and fair manner while also ensuring compliance with regulations and promoting transparency.

I, [Seller's Username], hereby acknowledge that as a seller partnering with Palmstreet, I understand and agree to the following terms and conditions regarding giveaway disputes:
- I acknowledge that any giveaway disputes that may arise between buyers and sellers are the sole responsibility of the involved parties, and Palmstreet shall not be held liable for any damages, losses, or disputes arising from such transactions.
- I agree that it is my responsibility as a seller to handle and resolve any giveaway disputes that may arise in a professional and timely manner, ensuring customer satisfaction and adherence to Palmstreet's policies and guidelines.
- I agree to post the following in the Notes section of the live(s) where I will provide giveaways: "Free Giveaway, no cost to enter! You can enter by purchasing a product or by sending in a postcard or letter to [enter physical address]. Winner will be selected after all entries have been received and compiled." (Physical mail is the only acceptable free form of entry on Palmstreet)
- I release Palmstreet, its employees, agents, and affiliates from any liability, claims, or disputes related to giveaway transactions conducted through the platform provided by Palmstreet.
- I confirm that I have read and understood Palmstreet's policies and guidelines regarding giveaways and agree to comply with them at all times.
