Scope
This policy covers all cosmetics and fragrances sold or given away on Palmstreet, including, but not limited to: makeup, skincare (e.g., moisturizers, lotions, serums, masks), haircare (e.g., shampoos, conditioners), nail products, perfumes, deodorants, and similar items.
General Requirements
- Legal Compliance: All products and listings must comply with applicable federal, state, and local laws and regulations, including FDA and FTC regulations as well as any additional requirements for ingredients, labeling, and claims.
- Original Packaging & Condition: All cosmetics and fragrances must be in their original, unopened manufacturer’s container. Products must be new and unused. Items cannot be sold or given away if transferred to another container, even if the outer retail box is damaged. Products with broken, tampered, or resealed seals are not permitted.
- Labeling: Products must be properly labeled in English, including the product name, use/purpose, net contents, full ingredient list, manufacturer/distributor/importer name and address, and any legally required warnings or allergen information. Claims must be truthful, non-misleading, and substantiated. Disease-related claims (e.g., “treats acne,” “cures psoriasis”) are prohibited unless FDA-approved and labeled as both a drug and cosmetic. All products must be properly labeled in compliance with FDA regulations and the Modernization of Cosmetics Regulation Act (MOCRA).
- Safety: Items must not be subject to recall, FDA safety alert, or identified as adulterated or misbranded. Prohibited ingredients (such as those banned under FDA or state law) are not allowed. Items must not require a prescription or medical supervision.
Specific Product Prohibitions
- Counterfeit and Imitation Items: Counterfeit products or those infringing trademarks are strictly prohibited.
- Opened or Used Products: Any used, opened, tested, swatched, or partially used cosmetics, or previously used applicators (sponges, brushes, etc.) are not allowed.
- Expired and Old Stock: Expired products, or those past their “best before” date, may not be sold or given away.
- Skin-Bleaching Agents: Skin-bleaching products are prohibited.
Additional Requirements
- Product Codes: Products must display identifying codes (lot numbers, serial numbers, matrix codes, batch codes) placed by the manufacturer or distributor.
- Adverse Event Reporting: Sellers must provide clear contact information for adverse event reports, such as a domestic address, phone, or website.
- State-Specific Restrictions: Where applicable, comply with state-specific rules (e.g., California’s and Washington’s toxic-free cosmetic laws, ingredient disclosure laws).
- Prohibited Substances & Ingredients: No products containing banned or restricted substances (e.g., mercury, certain dyes, PFAS, formaldehyde-releasing agents, etc.)
