Plant Identification, Inc. (collectively, "Palmstreet", "we", "us," "our") operates the Palmstreet mobile messaging program (the "Program"). These SMS Terms of Service (these "SMS Terms") govern your participation in the Program. By opting in to receive text messages from Palmstreet, you agree to these SMS Terms, our Terms of Service (https://palmstreet.app/terms-of-conditions), and our Privacy Policy (https://palmstreet.app/privacy-policy). To the extent an inconsistency exists between these SMS Terms and the Terms of Service with respect to the Program, these SMS Terms shall govern.
1. Program Description
The Program consists of recurring marketing and promotional text (SMS/MMS) messages sent by or on behalf of Palmstreet to the mobile number you provide at opt-in. Message content may include, without limitation: promotions and offers; updates and announcements regarding your Palmstreet seller account and seller opportunities; live show alerts and reminders; onboarding tips and resources; and other marketing communications related to the Palmstreet Platform.
2. Consent and Opt-In
You consent to receive Program messages by affirmatively opting in, including by checking the Marketing SMS consent checkbox on a Palmstreet form where your mobile number is collected. Your consent to receive marketing text messages is not a condition of purchasing any goods or services, applying to sell on the Platform, or otherwise using the Platform. You represent that you are the account holder for the mobile number you provide, or that you are authorized to consent on the account holder's behalf, and that you are at least eighteen (18) years of age.
3. Message Frequency
Message frequency varies. Palmstreet reserves the right to change the frequency of messages sent under the Program at any time.
4. Message and Data Rates
As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
5. How to Opt Out
You can cancel the SMS service at any time by texting "STOP" to the number from which you receive Program messages. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
6. Help and Support
If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance, or you can get help directly at info@palmstreet.app.
7. Carriers
Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to the effective transmission of your wireless carrier and the capabilities of your mobile device.
8. Privacy
Your participation in the Program is subject to our Privacy Policy, available at https://palmstreet.app/privacy-policy, which describes how we collect, use, share, and protect your personal information. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text message services.
9. Eligibility and Supported Carriers
The Program is intended for users located in the United States who are eighteen (18) years of age or older. The Program is offered on an "as is" basis and may not be available in all areas at all times, and may not continue to work in the event of product, software, coverage, or other changes made by your wireless carrier.
10. Changes to the Program and These SMS Terms
We reserve the right to change these SMS Terms or cancel the Program at any time upon notice. We may give notice by posting the updated SMS Terms on the Platform or by any other reasonable means. Your continued participation in the Program after the date of the updated SMS Terms will constitute your acceptance of the updated SMS Terms. If you do not agree to the updated SMS Terms, you must opt out of the Program as described in Section 5.
